On March 23, 2022, the National Assembly of Vietnam issued Resolution No. 17/2022/UBTVQH15 stipulating the number of overtime hours per year and per month of employees
According to this Resolution:
- From January 1, 2022, employers and employees can make an agreement to work overtime for 200 hours/year to 300 hours/year, applicable to all industries and jobs. Instead of only applying to certain jobs as specified in the Labor Code 2019;
- From April 1, 2022, If eligible to apply overtime caps of 300 hours/year then the employer can make an agreement with the employee to work from 40 hours/month to 60 hours/month.
- Overtime working of more than 200 hours/year is not allowed apply to the following people:

- Employees under 18 years old;
- The employee is a mildly disabled person with a working capacity decrease of 51% or more, a severe disability or a particularly severe disability;
- Disabled employees;
- Female employees are pregnant from the 7th month or from the 6th month if working in highland, remote, border or island areas;
- Female employees are nursing children under 12 months old.
